Abstract
U radu se obrađuje sloboda kretanja radnika kao jedna od četiri temeljne slobode Europske unije pored slobode kretanja robe, kapitala i usluga. Sloboda kretanja radnika utvrđena je člankom 45. UFEU, a obuhvaća: pravo radnika na kretanje i boravak, prihvaćanje ponuda za zaposlenje i ostanak u državi domaćinu nakon prestanka zaposlenja. Budući da je mobilnost radne snage neizostavna za učinkovito i uspješno funkcioniranje unutrašnjeg tržišta Europske unije, slobodno kretanje radnika izdvaja kao posebno osjetljivo i važno pitanje za Europsku uniju. Stoga Europska Unija obično postavlja određena ograničenja u slobodnom kretanju radnika iz novih država članica. Ograničenja mogu biti vezana uz javni poredak, javno zdravlje, javnu sigurnost, a jedno od njih je i tranzicijsko razdoblje. Kroz sudsku praksu analiziran je utjecaj Suda EU na razvoj i jačanje slobode kretanja radnika i zaštitu prava građana Europske unije.
Abstract (english)
In this paper we are going to elaborate freedom movement of workers as one of the four fundamental freedoms of the European Union in addition to the free movement of goods, capital and services. Freedom of movement for workers is laid down in Article 45 of the TFEU, which includes: the right of workers to move and reside, accept employment and stay in the host country after termination of employment. Since labor mobility is inevitable for the efficient and successful functioning of the European Union's internal market, free movement of workers is identified as a peculiarly sensitive and important issue for the European Union. Therefore, the European Union usually places certain restrictions on the free movement of workers towards the new Member States. Restrictions can be related to public order, public health, public security, and there we also can include transition period. Throught Court case study is analyzed influence of the Court of Justice on the development and strengthening of the freedom movement of workers and the protection of the citizens rights of the European Union.
