Abstract Završni rad iz predmeta Povijest uprave obradio je temu „Magna Carta i početci Engleske ustavnosti“. Izovri kojima sam se koristio u završnome radu bili su knjige, članci i internetske stranice. Na temelju toga u završnom radu se nalaze zaključci da je kao reakcija od strane plemića na tiransku vladavinu kralja Johna i njihova pobuna protiv njega, a ujedno i Johnova želja da se spriječi građanski rat, donesena Magna Carta. Najvažnije odredbe koje nam o tome govore, a koje su ujedno na snazi i danas su najprije člnaci 39. i 40. Uz to, dokument Magne Carte jamči neka osobna prava, koja danas spadaju u prve generacije prava i sloboda. Te slobode tek krajem 18. stoljeća počinju biti uključivana u deklaracije poput Američke povelje o pravima iz 1791. Magnu Carta se ne može promatrati kao pojedinačna, već pirpada širem krugu, krugu jednog razdoblja i kompletnog vijeka. Upravo iz tog razloga u ovom radu daje se pozornost na događaje prije, za vrijeme te nakon nastanka Magne Carte uz neizostavnu analizu dokumenta pod nazivom Charter of Liberties Henrya I. iz 1100. godine, bitnog dokumenta za početak ustavnosti u Engleskoj. Nakon potpisivanja Magne Carte 15- tog dana mjeseca lipnja 1215. kopije su napravljene radi njezina slanja. Četiri kopije su sačuvane: dva primjerka su u British Library, po jedan u Lincoln Chatedral i u Salisbury Catherdral. Navedene imaju jedan list pregamene, a uvod i 63 članka nemaju, to su naknadno učinili pravni stručnjaci zbog praktičnih razloga. Smatra se da su kraljevi od Henrya III – Henrya – V izdavali njezine potvrde kojih je bilo pedeset. Zlatna bula smatra se mirovnim sporazumom između pobunjenog plemstva i kralja, koju kralj donosi jer ne želi pobunu donacionalnog plemstva. Iz toga proizlazi sličnost dvaju dokumenata isprezentiranih kao sporazumi priznavanja određenih sloboda pojedincima i u kojima se uređuju i druga pravna pitanja. Ustav Ujedinjenog Kraljevstva razlikuje se od mnogih drugih po tome što njegovi ključni aspekti nisu sadržani u jednom pravnom izvoru. Zbog toga je Magna Carta postala značajna jer možemo vidjeti porijeklo ustavnog načela: vladavine prava, koja je temeljno načelo Magne Carte sudaca.
Abstract (english) The final paper from the History of Administration course dealt with the topic „Magna Carta and the beginnings of English constitutionalism“. The metods I used in the final paper were books, articles and websites. Based on this, the final paper concludes that the Magna Carta was enacted as a reaction by the nobles to the tyrannical rule of King John and their rebellion against him, and at the same time John desire to prevent a civil war. The most important provisions that tell us abaout this,and which are still force today, are first of all Articles 39 and 40. In addition, the Magna Carta document guarantees some peronal rights, which today belong to the first generations of rights and freedoms. These freedoms only began to be included in declarations such as The American Bill of Rights from 1791., only at the end of 18th century. The Magna Carta cannot be viewed as an individual, but touches a wider circle, the cirlce of a period and a complete century. It is for this reason that this paper pays attention to the events before, druing and after the creation of the Magna Carta along with indispensable analaysis of the document called Charter of Liberties by Henry I. from 1100, an important docuent for the beginning of constitutionalism in England. After the Magna Carta was signed on June 15, 1215. copies were made for its distribution. Of these copies we have four preserved today: two copies are in the British Library, one each in Lincoln Cathedral and one in Salisbury Cathedral. Each of the above has one sheet of pregame, and the introduction and the 63 articles do not, this was done by leagl experts due to practical reasons. It is believed to have had fifty certificates issued by kings since Henry III. to Henry V. The Golden Bull is considered a peace agreement between the rebellious nobility and the king, which the king makes beacuse he does not want a revolt by the sub-national nobility. This results in the similarity of two documents presented as agreements recognizing certain freedoms for individual and in which other legal issues are regulated. The UK Constitution differs from many others in that key aspects of it are not contained in a single legal source. This is why Magna Carta became significiant because we can see the origin of a constitutional principle: the rule of law, which is the fundamental principle of the Magna Carta of judges.
