Abstract
This paper comes at the time when significant achievements have been made in the area of asylum law and policy at the EU level and when the period of harsh criticism and instability has just turned down. The aim of this paper is to present the development of the Dublin System from the very beginning, including the overview of the broader system – the Common European Asylum System and then to compare two main legislative instruments of the Dublin System, namely the Dublin II Regulation and its recast version i.e. Dublin III Regulation and to analyze its most controversial provisions into details. In the period after the World War II, the international community yielded important documents promoting human rights protection among which was also the 1951 Refugee Convention. The Refugee Convention is the key legal document in defining who is a refugee, their rights and the legal obligations of states.
