Nakon kraćeg uvoda i općenitog određenja glavnih pojmova u ovoj tematskoj materiji (državna služba, državni službenik, prava i obveze službenika u državnim tijelima), detaljnije se daje prije svega normativnopravni prikaz i analiza zakonskih razloga koji dovode do prestanka službe u državnim tijelima primjenom Zakona o državnim službenicima, kao posebnog (lex specialis) propisa i Zakona o radu kao osnovnog (općeg) propisa. Rad se sastoji od sedam poglavlja. Nakon uvoda, dan je kraći opći pojmovni prikaz instituta državne službe i državnih službenika. Nakon toga, u središnjem dijelu rada detaljno su navedeni i analizirani pojedinačni zakonski razlozi i vrste prestanka državne službe: sporazumni prestanak, prestanak službe istekom roka, otkaz iz službe, prestanak službe po sili zakona i drugi načini. Analizirani su i posebni razlozi za prestanak državne službe, kao što su: nepolaganje državnog stručnog ispita, napuštanje službe, neopravdano neizvršenje rješenja o premještaju, negativna ocjena rada državnog službenika, izricanje disciplinske kazne prestanka državne službe te osuda za kazneno djelo. U okviru navedenih tematskih jedinica, u posebnom poglavlju, nakon uvodnog objašnjenja odgovornosti državnih službenika, dan je osvrt na vrstu povreda službene dužnosti (lake i teške povrede), sankcije za povrede službene dužnosti te s tim u vezi udaljenje iz službe.
Ukazano je i na pravo na pravni lijek protiv odluka o prestanku državne službe izrečene po bilo kojoj od navedenih osnova. Posebno poglavlje posvećeno je ulozi Hrvatskoga sabora u donošenju Zakona o državnim službenicima, kojim su cjelovito uređena prava i obveze državnih službenika, s posebnim osvrtom na ulogu Odbora za zakonodavstvo u donošenju navedenog Zakona. U posljednjem zaključnom poglavlju rada dan je sumiran prikaz glavnih uređenja i zaključaka o razlozima i vrstama prestanka državne službe te mogućim prijedlozima za poboljšanje normativnog uređenja materije koja se odnosi na državnu službu i državne službenike.
Abstract (english) This thesis presents the legal reasons for termination of civil service in state bodies. After a short introduction and general definitions of the main terms in this subject matter (civil service, civil servant, rights and obligations of officials in state bodies), the normative-legal view and analysis of legal reasons that result in the termination of service in state bodies by applying the Civil Servants Act as a more specific (lex specialis) and the Labour Act as the basic (general) regulation are discussed in more detail. The thesis consists of seven chapters. After the introduction, a shorter general overview of the institute of civil service and civil servants is given. Thereafter, in the central part of the thesis, the individual legal grounds and types of termination of civil service are detailed and analysed: agreement termination, termination of service on the grounds of expiration of deadline, dismissal from service, termination of service by force of law and other manners. Special reasons for the termination of civil service were analysed, such as: non-passing of state examination, abandonment of service, unjustified non-execution of the decision on transfer, negative evaluation of the civil servant's performance, imposition of disciplinary penalty of termination of civil service and sentence for a criminal offense. Within the aforementioned theme units, in a separate chapter, following the introductory explanation of civil servants' responsibilities, an overview of the types of violation of official duty (minor and major violations), sanctions for violations of official duty and related removal from the service is given. The right to a remedy against the decision on the termination of civil service imposed on any of the abovementioned grounds is also mentioned. A special chapter is devoted to the role of the Croatian Parliament in the adoption of the Civil Servants Act, which fully regulates the rights and obligations of civil servants, with particular reference to the role of the Committee for Legislation in the adoption of this Act. In the final chapter of the thesis, a summary of the main arrangements and conclusions on the causes and types of termination of civil service and possible proposals for improvement of normative regulation of matters relating to civil service and civil servants is given.
