Abstract
Tema ovog diplomskog rada je bankarska garancija kao instrument osiguranja izvršenja obveza,s posebnim naglaskom na bankarsku garanciju na prvi poziv. U radu je obrazložen pojam i gospodarska uloga te su prikazana osnovna obilježja i pravni odnosi koji se pojavljuju u svezi s bankarskom garancijom. Rastumačene su sličnosti i razlike u odnosu na ostale slične pravne institute te su analizirani pravni izvori koji uređuju bankarsku garanciju. Prikazane su vrste bankarske garancije s obzirom na svrhu izdavanja i uključivanje još jedne banke u obvezu plaćanja.Za kraj je ostavljen osvrt na bankarsku garanciju u formi dokumentarnog akreditiva.
Abstract (english)
The subject of this thesis is a bank guarantee as an insurance for executing obligations, with the special emphasis on demand guarantee. This thesis deals with the concept and the point of economic function, and it presents basic features and legal relations which appear in the matter of a bank guarantee. There are interpreted the similarities and differences between other similar legal institutes. There are analyzed legal resources which deal with bank guarantee. There are also presented types of bank guarantees considering the type of issuing and including another bank in payment obligation. Finally, there is a review on standby letter of credit.
