This thesis deals with the topic of diplomatic asylum. The first part is an elaboration on the concept of asylum and the rights of asylum. Firstly, it focuses on the legal sources which represent the basics of establishment and codification of the concept of asylum. Apart from that, relevant sources of the acquis communautaire are mentioned. Following the explanation of the notion of prohibited return (non-refoulement), the categories of asylum are outlined. The aim of this paper is to analyze the notion of diplomatic asylum through clarification of the concept of asylum and description of its particularities and differences in relation to territorial asylum. Consular asylum is also mentioned and its (non) applicability in practice. The thesis denotes the practice on Latin America`s teritorry and its relevant regional documents. Moreover, the Vienna Convention on Diplomatic Relations of 1961 is described accentuating the provisions and interpretations concerning diplomatic asylum. The final part of this thesis depicts significant cases and singles out individual opinions of the International Court of Justice.
