The theme of this final work is rental Agreement. This work is unfiled into a five interrelated thematic sections which are arranged in a logical order and importance. The introduction contains the explanation of the basic issue and the object of the research, there is also defined its purpose and objective which are set in essential hypothesis. In the second part, called the concept and history of the rental agreement, the short historical development of the rental agreement is the elaborated and it is supported by the case law. Further, in this final work is processed form of the rental agreement, mutual obligations of the parties (the lessor and lessee) but the emphasis will be placed in the difference in terms of the lease agreement with examples of case law. In the third part, named agreement of a lease, there will be consider the provisions of the lease with an example of case law. The fourth part, named rental apartment in the legal systems of continental European legal circle, will analyze German and Austrian legal system of the implementing the survey "The reality of the student renting an apartment "in terms renting housing, which is not regulated by the Law on Apartment Lease and will point out the shortcomings of the lack of specific legal regulations as such. The conclusion is the final part and it is bringing a systematic and concise presentation of relevant knowledge, facts and opinions that are more developed in the paper.
