Abstract
U situacijama kada je rizik uporabe motornih vozila postao toliki da su njegove štetne posljedice, odnosno prometne nezgode počele predstavljati društveni problem, pojavilo se obvezno osiguranje od automobilske odgovornosti kao jedan od oblika društveno obrambenih mehanizama, koje se ubraja u red ugovornih obveznih osiguranja kod kojih je obveza osiguranja propisana zakonom, a samo sklapanje ugovora prepušteno strankama. Prema Zakonu o osiguranju pokrivene su štete, nastale na teritoriju Republike Hrvatske i teritoriju država članica Sustava zelene karte osiguranja, zbog smrti, tjelesne ozljede, narušavanja zdravlja i uništenja ili oštećenja stvari. Obveza osiguratelja je ograničena isključenjem iz osiguranja i gubitkom prava iz osiguranje. Osiguranje od automobilske odgovornosti je uvedeno prvenstveno radi zaštite trećih oštećenih osoba, te Zakon o osiguranju propisuje da je osiguratelj kod koga je osigurano vozilo dužan isplatiti štete prouzročene tim vozilom. Ovim osiguranjem štite se i žrtve neosiguranih i neidentificiranih vozača motornih vozila i u drugim slučajevima kada štete pokriva Garancijski fond za zaštitu žrtava prometa kojim rukovodi Hrvatski ured za osiguranje.
