Abstract
Tema ovog rada je analiza ugovora profesionalnih nogometaša te sustava transfera. Da bismo mogli razumjeti ugovorne odnose između profesionalnih nogometaša i klubova te sami sustav transfera, potrebno je prije svega proučiti ugovorno pravo i njegova temeljna načela. Nadalje, ovaj rad bavi se problematikom sklapanja ugovora profesionalnih igrača s klubovima u hrvatskom i međunarodnom pravnom okviru, načinima rješavanja sporova pred domaćim i međunarodnim arbitražnim sudištima, kao i očuvanjem stabilnosti ugovora, sustavom transfera i, napose, ulogom posrednika koji skrbe o interesima igrača odnosno klubova. Hrvatsko pravo dopušta sklapanje tri vrste ugovora, a to su: ugovor o profesionalnom igranju, stipendijski ugovor i ugovor o radu. Proučava se i monopolno – hijerarhijski ustroj nogometa prema kojem na teritoriju jedne države može biti samo jedan nogometni savez. Nacionalni nogometni savezi potpadaju, posredno, pod svjetsku nogometnu organizaciju, FIFA-u, čiji zadatak je osigurati jednakost nogometnog natjecanja na globalnoj razini kroz jednakost svih natjecatelja, ali i izgraditi precizan i jasan pravni okvir koji će pružiti pravnu sigurnost svim akterima nogometne igre.
Abstract (english)
The main point of this thesis is analyzing contracts of professional football players and system of football transfers. To figure out contract relations between professional football players and their clubs, it is necessary to study contract law and it`s fundamental principles. Moreover, this final work will cover problems of signing contracts between football clubs and players in Croatian and world legal form, solving problems through Crotian and foreign arbitral tribunals, keeping contract stability, transfer systems, and the role of football managers who protect interests of players and clubs. There are three types of contracts that Croatian law allows, professional playing contract, scholarship agreement, and employment contract. Also there will be monopoly – pyramidal structure according to which there can be only one football associationon at the territory of one state. National football association is part of world football organization called FIFA. The main role of FIFA is to ensure equality of football competition on global level through equality of competitors, but also to give precise and clear legal frame that will provide safety to all football participants.
