Abstract Završni rad govori o turističkim agencijama i njihovom statusu i ugovorima u hrvatskom pravu. Turističke agencije su subjekti trgovačkog prava čija se temeljna djelatnost sastoji u organiziranju i sklapanju ugovora, ugovora vezanih uz boravak turista u nekom kraju te pružanju drugih usluga svojim klijentima. Funkcije turističkih agencija su informativno – savjetodavni poslovi, posrednički poslovi, poslovi u ulozi organizatora putovanja i ostali različiti poslovi poput mijenjanja valute. Postoji više vrsta turističkih agencija, među kojima su detaljističke one koje posluju kao trgovci na malo, grosističke koje su trgovci na veliko, samostalne i zavisne. Bitno ime za turističke agencije je Thomas Cook, koji je organizirao prvo putovanje u 19. stoljeću. Da bi turističke agencije lakše štitile svoje interese i unaprjeđivale poslovanje, postoje udruge poput UHPA-e (Udruga hrvatskih putničkih agencija), koje im to olakšavaju. Na međunarodnoj razini djeluju udruge UFTAA, WATA, ASTA, IATA i ostale. U turističkim ugovorima turističke su usluge glavni sadržaj, bez obzira na subjekte koji ih sklapaju. Zakoni, koji štite turiste koji borave na području Republike Hrvatske, su Zakon o zaštiti potrošača i Zakon o turističkoj djelatnosti, pomoću kojih se osigurava zaštita turista. Ugovori koje sklapaju agencije dijele se na ugovore koje sklapaju s korisnikom usluga i na ugovore koje agencije sklapaju s davateljem usluga. Ugovori koje sklapaju agencije s korisnikom usluga dijele se na ugovore o organiziranju putovanja i posredničke ugovore o putovanju. Ugovori između putničke agencije i davatelja usluga dijele se na agencijski ugovor o hotelskim uslugama, ugovor o angažiranju ugostiteljskih kapaciteta, ugovor o zakupu ugostiteljskog objekta te ugovor o zastupanju između hotelskog zastupnika i hotelijera.
Turističke agencije trebaju zadržati svoju likvidnost tako da zadobiju povjerenje klijenata, putem djelotvornog i kvalitetnog organiziranja putovanja.
Abstract (english) The thesis discusses tourist agencies and their status and contracts related to Croatian legislation. Tourist agencies are commercial law entities whose principal activity consists of organizing and entering into agreements, agreements related to tourist accommodation at a certain destination, and offering other services to their clients. The activities of tourist agencies include informative - consulting, mediating, the role of tour operators, and other various tasks such as exchanging currencies. There are several types of tourist agencies including specialized agencies such as those operating as retailers, those operating as wholesalers, independent, and dependent. An important name among tourist agencies is that of Thomas Cook, who organized the first trip in the 19th century. Associations such as UHPA (Udruga hrvatskih putničkih agencija; Association of Croatian Travel Agencies) exist in order for tourist agencies to protect their interests and improve their business. Associations that operate on an international level are UFTAA, WATA, ASTA, IATA, and others.
The main contents of tourism agreements are tourism services regardless of the parties entering into agreement. Laws that protect tourists staying in Croatia are the Consumer Protection Act and the Law on Tourism, which ensure the protection of tourists. Agreements which agencies enter into are divided into those entered into with service users and those entered into with service providers. Agreements between agencies and service users are divided into agreements on travel organisation and intermediary travel agreements. Agreements between travel agencies and service providers are divided into agency agreements on hotel services, agreements on engaging catering facilities, agreements on leasing catering facilities, and agency agreements between the hotel representatives and hoteliers.
Tourism agencies must maintain their liquidity by achieving clients’ trust and through effective and high quality travel organisation.
